Businesses: Violation of federal and state constitutions and of statutory provisions There is no pandemic exception to fundamental, constitutionally-protected liberties.
The First Amendment guarantees the right of association and the free exercise of religion, which have been violated by the limits imposed on public, private, and religious gatherings.
The Fourteenth Amendment ensures that the rights established by the Federal Constitution must be honored by state governments as well.
Directives to close small businesses and stay home violate the Constitution and exceed statutory authority. These orders are arbitrary and capricious, based on the whim of the Governor and subject to political pressure. As a result, small businesses are left with no appeal but to the courts.
